Terms of Service

1.1. These Terms of Service govern the use of the website available at https://aiess.pl (hereinafter: the "Website").

1.2. The owner and administrator of the Website is OLMAR TRADE Sp. z o.o. with its registered office in Nowe Skalmierzyce, Plac Wolności 3A, 63-460 Nowe Skalmierzyce, registered in the National Court Register, VAT ID: PL6222838445 (hereinafter: "Administrator" or "AIESS").

1.4. Use of the Website is voluntary and indicates acceptance of these Terms of Service.

1.5. The Administrator reserves the right to change these Terms of Service. Users will be informed of changes through publication of the new version on the Website.

2.1. User – any natural person, legal entity, or organizational unit without legal personality using the Website.

2.2. Content – all materials published on the Website, including articles, photos, graphics, videos, technical data, and documentation.

2.3. Calculator – an online tool available at kalkulator.aiess.pl for estimating energy savings and selecting BESS systems.

2.4. Partner Panel – a dedicated platform for business partners available at partner.aiess.pl.

2.5. BESS – Battery Energy Storage System.

3.1. The Website serves to present AIESS offerings, including:

• Battery Energy Storage Systems (BESS)
• AI software for energy management
• Consulting services and energy audits
• Cooperation with photovoltaic installers

3.2. The Website enables:

• Browsing information about products and services
• Using the savings calculator
• Contacting AIESS through a contact form
• Access to educational materials and blog
• Newsletter subscription (with consent)

3.3. The Website does not conduct online sales. Transactions are carried out through direct contact with the sales department or Partner Panel.

3.4. The Administrator does not perform BESS system installations – we work with certified installers.

4.1. The User is obliged to:

• Use the Website in accordance with the law and good practices
• Not undertake actions that could disrupt the Website's operation
• Not use the Website for purposes contrary to the law
• Provide truthful data in contact forms

4.2. It is prohibited to:

• Introduce content to the Website contrary to the law
• Copy the Website's source code
• Attempt unauthorized access to AIESS IT systems
• Use automatic tools for mass content downloading (except AI crawlers in accordance with Content License)

5.1. All content published on the Website, including texts, graphics, logos, photos, videos, databases, and software, is protected by copyright and is the property of OLMAR TRADE Sp. z o.o. or third parties that have granted licenses.

5.2. The AIESS trademark is registered with the European Union Intellectual Property Office (EUIPO) under application number 019133260 and is protected.

5.3. Use of Website content is permitted in accordance with the Content License and Citation Policy (CC BY 4.0).

5.4. Use of logos, trademarks, and product photos requires written consent from the Administrator.

6.1. Detailed information about personal data processing can be found in the Privacy Policy.

6.2. The Administrator processes personal data in accordance with GDPR (Regulation EU 2016/679).

6.3. Use of the Website may involve processing of personal data provided voluntarily by the User.

6.4. The Website uses cookies in accordance with the Cookie Policy.

7.1. The Administrator makes every effort to ensure that information on the Website is current and reliable, however, is not liable for decisions made by Users based on it.

7.2. Calculator results are estimates and may differ from actual savings.

7.3. The Administrator is not liable for:

• Website availability interruptions due to maintenance, failures, or force majeure
• Damage resulting from malware
• Content posted by third parties (external links)

7.4. The Administrator's liability is limited to the amount of actual damage suffered by the User, excluding statutory liability.

9.1. Polish law shall apply to all disputes arising from these Terms of Service.

9.2. The court with jurisdiction to resolve disputes is the court with jurisdiction for the Administrator's registered office, unless mandatory provisions state otherwise.

9.3. Matters not regulated by these Terms of Service shall be governed by Polish law.

9.4. The Administrator reserves the right to change these Terms of Service. Changes take effect 14 days after publication of the new version.

9.5. If any provision of these Terms of Service is found to be invalid, the remaining provisions remain in force.
